Telangana’s Chief Electoral Officer has informed the Election Commission of India that the Khairatabad Assembly constituency is vacant following the disqualification of former MLA Danam Nagender, completing an important administrative step before a future by-election can be scheduled.
The development follows court proceedings over Nagender’s change in political affiliation and his 2024 Lok Sabha candidature. The Telangana Assembly Secretariat has issued a Gazette notification recording the vacancy with effect from April 23, 2024, the date identified in the court-directed disqualification.
How the vacancy arose
Nagender was elected to the Telangana Assembly from Khairatabad on a Bharat Rashtra Samithi ticket. He later joined the Congress and contested the Secunderabad Lok Sabha constituency as a Congress candidate while continuing as an MLA. Petitions seeking his disqualification were pursued under the anti-defection framework.
The Telangana High Court disqualified him, and the Supreme Court subsequently declined to interfere with that outcome. The Assembly Secretariat then formally notified the vacancy under the constitutional and Tenth Schedule framework cited in its notification.
Election Commission now has the next administrative role
With the state CEO communicating the vacancy to the Election Commission of India, the national poll body will determine the timing of the by-election in accordance with election law and the applicable calendar. No by-election date should be treated as final until the Election Commission formally announces it.
Reports have discussed possible timing alongside other elections, but those references are expectations rather than an official schedule.
Why the seat matters
Khairatabad is a prominent Hyderabad constituency, and a by-election would provide voters with a fresh opportunity to choose representation after the anti-defection proceedings. The contest is likely to draw attention from the Congress, BRS and BJP, but the electoral outcome cannot be inferred from the legal dispute that produced the vacancy.
The case also has broader institutional significance. Anti-defection law is intended to address legislators changing political allegiance under circumstances specified in the Tenth Schedule. Courts, Speakers and election authorities perform different roles in that process.
For voters, the immediate practical issues are the final electoral roll, candidate nominations and the official polling schedule. Those details should be taken from the Election Commission once notified.
